Welcome to SPOAKL, a community platform designed to connect customers with local cottage food entrepreneurs. By accessing or using www.spoakl.com or any related services (“the Site”), you agree to the following Terms and Conditions. If you do not agree, please do not use the Site.

1. Overview of Our Role

SPOAKL is a community-driven marketplace and storytelling platform that:

• Showcases home-based cottage food makers and their products

• Enables customers to purchase these products through our website

• Hosts the SPOAKL Podcast to share the stories of local entrepreneurs

We facilitate transactions, but we do not produce, package, or fulfill any orders. Products are made and delivered by independent sellers who use SPOAKL as a platform to reach customers.

2. Cottage Food Disclosures

Products listed on SPOAKL are made in home kitchens under local cottage food laws. These kitchens may not be inspected by the Department of Health.

Sellers are solely responsible for complying with local cottage food regulations and for providing accurate product descriptions, including ingredients, allergens, and pickup/delivery methods.

Buyers are responsible for reviewing this information prior to purchase and assume all risk associated with consumption.

3. Orders and Payment

When you place an order on SPOAKL:

• Your payment is processed through our secure payment system (e.g., Wix Payments)

• SPOAKL collects payment on behalf of the individual seller

• The seller receives order information and is responsible for fulfillment

• After confirmation, SPOAKL pays the maker directly, minus any applicable platform or processing fees

All fulfillment-related questions should be directed to the seller.

4. Cancellations, Refunds, and Disputes

SPOAKL does not guarantee refunds or cancellations. Each maker may set their own policies. If you experience an issue with your order, contact the seller first.

SPOAKL is not liable for order delays, miscommunication, or product dissatisfaction.

5. User Conduct

By using SPOAKL, you agree not to:

• Violate any applicable laws

• Misrepresent your identity

• Post abusive, misleading, or harmful content

• Interfere with the operation of the site

We reserve the right to suspend or remove access for any reason.

6. Intellectual Property

All content on this site — including text, logos, podcasts, graphics, and photos — is the property of SPOAKL or its contributors and may not be reused without permission.

7. Disclaimers and Liability

SPOAKL does not inspect, guarantee, or endorse products sold on the platform. You agree that:

• Products are provided “as is” by third-party sellers

• SPOAKL is not liable for any illness, injury, or damages related to consumption or use

• Use of the platform is at your own risk

8. Changes to These Terms

We may update these Terms and Conditions at any time. Continued use of the platform signifies acceptance of the latest version.
